Terms of Use
These Terms of Use (“Terms”) are an agreement between you and Beren Kaul, the individual developer of FloorLens (“we”, “us”), governing your use of the FloorLens app, website (floorlens.app) and web viewer (together, the “Service”). By using the Service you agree to these Terms. If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 16 years old to use the Service. By using FloorLens you confirm that you meet this requirement and that you can form a binding agreement.
2. The Service
FloorLens lets you scan rooms and homes with a compatible iPhone or iPad, create floor plans and 3D models, take measurements, edit scene elements, export your work, and — with a Premium subscription — upload a scan to the web so others can view it in a browser. Some features rely on third-party services (Apple and Google) and on an internet connection.
3. Accounts & sign-in
Most features work without an account. You only need to sign in (with Sign in with Apple or Sign in with Google) to upload a scan to the web. You are responsible for activity under your account and for keeping access to your Apple or Google credentials secure.
4. Subscriptions & payments
- Free. Scanning, editing, measurements, AI floor plans and exports listed as free are available at no cost.
- Premium. Premium is offered as an auto-renewing monthly subscription (e.g. $4.99/month) or a one-time lifetime purchase (e.g. $99). Localized prices are shown in the App Store.
- Billing via Apple. Purchases are processed by Apple and charged to your Apple Account. Monthly subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel a subscription anytime in your Apple Account settings.
- Lifetime purchase is a one-time payment for the relevant Premium features and does not auto-renew.
- Refunds. Purchases are made through Apple, so refunds are handled by Apple in accordance with the App Store terms and applicable law. You can request a refund from Apple here.
5. Your content & responsibilities
“Your Content” means the scans, models, photos, floor plans, labels, notes and other materials you create or upload. You retain ownership of Your Content. You are solely responsible for it, and you represent that:
- You have the right and any necessary permission or consent to scan the space and its contents, and to capture any photos.
- You will not scan, upload or share content unlawfully, including content that infringes others’ rights or that discloses other people’s personal data without a lawful basis.
- When you share a scan, you understand that anyone with the link or QR code can view it, and you are responsible for whom you share it with.
6. License you grant us
Solely to operate the Service, you grant us a limited, worldwide, royalty-free license to host, store, copy, process and transmit Your Content as needed to provide the features you use (for example, to store an uploaded scan and serve it to people you share the link with). This license ends when the content is deleted or expires, except for backups retained for a limited time and anything we must keep by law.
7. Our intellectual property
The FloorLens app, website, web viewer, name, logo and all related software and content are owned by us and protected by law. We grant you a personal, non-transferable, non-exclusive license to use the Service in accordance with these Terms. You may not copy, modify, distribute, sell or reverse engineer the Service except to the extent permitted by mandatory law.
8. Acceptable use
You agree not to:
- use the Service for unlawful purposes or in violation of these Terms;
- interfere with or disrupt the Service or its security, or attempt to access it in unauthorized ways (e.g. abusing the upload API or other accounts’ data);
- upload malware or attempt to overload, probe or circumvent our systems;
- misrepresent your identity or entitlement.
9. Third-party services
The Service relies on Apple and Google services. Your use of those services is also subject to their respective terms and privacy policies. We are not responsible for third-party services.
10. Availability & changes
We may add, change, suspend or discontinue features at any time, and some features may be offered as beta. We aim to keep the Service available but do not guarantee uninterrupted operation.
11. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind to the extent permitted by law. Measurements, floor plans, 3D models and other scan outputs are approximate and may contain errors. They are not a substitute for professional surveying and must not be relied upon for legal, structural, valuation, official or safety-critical purposes.
12. Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special or consequential damages, or for loss of data or profits, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited by law — including liability for intent or gross negligence — and your mandatory rights as a consumer remain unaffected.
13. Indemnity
You agree to indemnify us against claims, losses and expenses arising from Your Content or your misuse of the Service or violation of these Terms, to the extent permitted by law.
14. Termination
You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms or use the Service unlawfully. Sections that by their nature should survive termination (e.g. ownership, disclaimers, limitation of liability) will continue to apply.
15. Governing law & jurisdiction
These Terms are governed by the laws of Switzerland, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is the developer’s domicile in Switzerland. If you are a consumer, you also benefit from any mandatory consumer-protection rules of your country of residence, and these Terms do not deprive you of those protections.
16. Changes to these Terms
We may update these Terms from time to time. We will revise the “Last updated” date and, for material changes, provide a more prominent notice. Continued use of the Service after an update means you accept the revised Terms.
